By accessing or using ClaimRestored (claimrestored.com and the ClaimRestored application), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the platform. These Terms constitute a binding agreement between you and LossIntel Inc. ("we," "us," "our").
2. Description of Services
ClaimRestored provides AI-powered technology tools to help Florida homeowners review and understand their property insurance claims. Our services include:
- AI-assisted claim analysis comparing your claim against publicly available Florida DFS Civil Remedy Notice records.
- Document organization and evidence package assembly tools.
- FEMA and SBA disaster assistance eligibility screening.
- Statutory timeline and compliance information.
- Referrals (at your request) to licensed Florida public adjusters and attorneys.
ClaimRestored does not adjust claims, negotiate settlements, provide legal advice, or represent you before any insurer, court, or regulatory body. We are a technology platform only.
3. Eligibility
You must be at least 18 years old and a Florida homeowner or authorized representative of a Florida homeowner to use ClaimRestored. By creating an account, you represent that you meet these requirements and that all information you provide is accurate.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at help@claimrestored.com if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms.
5. Fees and Payment
ClaimRestored offers a free tier (Data Foundation) and paid service tiers. Current pricing is displayed at claimrestored.com/#pricing. All fees are in U.S. dollars. Paid services are charged at the time of purchase via Stripe. Fees are non-refundable except as described in Section 6.
6. Refund Policy
If you are unsatisfied with a paid service within 7 days of purchase and have not downloaded or shared your AI-generated report, you may request a full refund by contacting help@claimrestored.com. Refunds are processed within 10 business days. After 7 days or after report download, all sales are final.
7. Acceptable Use
You agree not to:
- Use ClaimRestored for any unlawful purpose or in violation of any applicable law or regulation.
- Submit false, fraudulent, or misleading claim information.
- Attempt to reverse-engineer, scrape, or extract our AI models or databases.
- Use the platform to harm, threaten, or harass any person.
- Interfere with or disrupt the platform's infrastructure.
- Misrepresent your identity or authority to submit a claim on another person's behalf.
8. Intellectual Property
All content, technology, algorithms, and design elements of ClaimRestored are owned by LossIntel Inc. and protected by copyright, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for personal, non-commercial claim-review purposes only. You may not copy, modify, distribute, or create derivative works from our platform.
You retain ownership of the documents and information you upload. By uploading content, you grant LossIntel Inc. a limited license to process your content for the sole purpose of providing ClaimRestored services to you.
9. Disclaimers
THE CLAIMRESTORED PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY SPECIFIC CLAIM OUTCOME WILL RESULT FROM USE OF OUR SERVICES.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOSSINTEL INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF CLAIMRESTORED, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless LossIntel Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of ClaimRestored, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of ClaimRestored shall be resolved by binding arbitration in Jacksonville, Florida under JAMS Streamlined Arbitration Rules. Class action and jury trial rights are waived to the extent permitted by law. You may opt out of arbitration within 30 days of first using ClaimRestored by emailing help@claimrestored.com.
13. Termination
We may suspend or terminate your access to ClaimRestored at any time, with or without cause, upon notice. You may close your account at any time by contacting help@claimrestored.com. Upon termination, your right to use the platform ceases immediately, though these Terms survive termination to the extent necessary to enforce our rights.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated by email or prominent notice on the platform at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
